accused by police. man picture was posted on oakland most wanted for about a month. nick smith with more on the mistake that turned a man's life upside down. >> friend called me and said that i was on the news for shooting. i was lake this must be some practical joke. >>reporter: but he wasn't laughing. he says his nightmare began in february of last year when friend said he was wanted for shooting they had seen this mug shot from an unrelated incident in 2007 and he was being named as one of oakland most wanted criminals. >> i went home and checked the internet and i was shocked. like, like why who will would do this to me. >>reporter: with his attorneys he says he went to police to tell them they have the wrong guy. >> this is not me. let's clear it up. >>reporter: he was quickly thrown in jail. three days later he was relessed. never charged with a crime and never told why or how his name became the focus of a criminal investigation. >> i was shameful. i don't know what people were thinking about me. >>reporter: 10 days after the ordeal began he says his name remained on oak

the bucket. 63 degrees in napa 63 in red wood city and 64 in oakland as well as an jobbing -- antioch. this is the strongest i have seen this breeze in a few days. tomorrow we will wake up with morning low clouds and the on shore breeze will continue and cooler air will be pooling in, in time for monday. this system here 655 miles off the coastline is not going to bring us any rain but it will bring us a ridge of high pressure through the weekend. as we get through tomorrow, this ridge shifting off to the east, the system that will move closer to the coast is not going to bring us any rain but again will kick up the sea breeze and will bring back the high clouds in the forecast and a cooler week ahead. temperatures for tomorrow afternoon are cooler than what we had today and the trend will continue as we get into tuesday and wednesday. here is the forecast model, a few clouds are hanging off the coastline and they will be hanging back as we get into tonight and tomorrow morning and we will wake up with low clouds and high country will continue for the afternoon. i will back it up and

'chez panisse'... is the site of this restaurant fire. >> it is still not known but the damage seems to be significant. there were not even sure if it was of the inside with the outside but they just responded at 3:00 a.m. let me show you video of one this actually was active. when they showed up the officials knew that it was a landmark restaurant. they have quickly figured it out that it was more of an exterior fire and an interior fire and were able to put it out. they just want to make sure that there is no further damage inside the building. so they are trying to tear down the branches because there is a large tree in front of the restaurant. making sure the there are no pockets of flames or smoldering inside. it seems to be pretty significant damage. they are saying that this is a out of commission. but the good news is that this is salvageable. there were sp

and friends are searching for an oakland woman missing for five days now. she was last seen jogging near 34th and telegraph on thursday morning. the 31-year-old was wearing gray pants, gray sweatshirt and red shoes. her family says oakland police aren't doing enough to find her. there is now a $1,000 reward for information in the case. a vigil will be held this afternoon. >>> developing news in afghanistan. two american troops were killed today in an insider attack. an afghan police officer opened fire inside a police station while u.s. forces were visiting there. three afghan policemen were also killed in that gun battle. also afghan officials say u.s. troops have and killed two afghan civilians as the truck was approaching an american convoy just outside of kabul. >>> north korea meanwhile has nullified the 1953 armistice which ended fighting in the korean war, that's according to the country's main newspaper. the communist government is upset by last week's united nations vote to impose more sanctions because of north korea's nuclear activities.
